Sajecki Planning Inc. provided expert planning support to the City of Hamilton in response to an Ontario Land Tribunal (OLT) appeal by LIV Developments Ltd. The appeal sought approvals for a 123-unit stacked townhouse development at 157 Parkside Drive, Hamilton, requiring an Official Plan Amendment (OPA), Zoning By-law Amendment (ZBA), and Site Plan Approval (SPA). The proposal aimed to reduce the planned density from 100 to 60 units per hectare, which was inconsistent with the Waterdown North Secondary Plan (WNSP) and Urban Hamilton Official Plan (UHOP).
The OLT ruled in favor of the City, dismissing the appeal, finding that the proposed density reduction did not align with the Provincial Policy Statement (PPS 2020) or Growth Plan for the Greater Golden Horseshoe. Our team provided expert testimony on urban structure, growth management, and housing diversity, demonstrating how the proposal would undermine planned intensification and compromise long-term city-building objectives.
